Summary:2The facts:—The claimant was party to the Austrian environmental impact proceedings concerning the construction of a section of the New Semmering Base Tunnel, a major railway project. She argued, inter alia, that the project would be contrary to Austria's international obligations under the UNESCO Convention concerning the Protection of the World's Cultural and Natural Heritage, 1972 (“the UNESCO World Heritage Convention”) with regard to the Semmering Railway World Heritage Site. Following the decision of the Minister of Transportation of 27 May 2011, which authorized the project while stipulating certain incidental provisions, the claimant appealed to the Supreme Administrative Court.
Held:—The appeal was denied with regard to the UNESCO World Heritage Convention. The decision was lifted on other grounds.
(1) The purpose of the UNESCO World Heritage Convention was the protection of cultural or natural heritage of exceptional importance, as well as the establishment of a collective system for the protection of that heritage (para. 9.3).
(2) In comparison to Article 6(3)3 of the UNESCO World Heritage Convention, which applied to the consideration of natural or cultural heritage located in the sovereign territory of another State party, Article 44 of the UNESCO World Heritage Convention stipulated a different, less far-reaching standard for the preservation of cultural or natural heritage located within a State's own sovereign territory. Article 4 of the UNESCO World Heritage Convention was to be understood in the sense of a basic political direction. Under that provision it was primarily the duty of each State party to ensure
the identification, protection and conservation and preservation of cultural or natural heritage located in its sovereign territory, as well as their transmission to future generations (paras. 9.4.1–9.4.2)(3) Article 11(2) of the UNESCO World Heritage Convention5 did not prescribe an additional obligation for the preservation of natural and cultural heritage included in the World Heritage List and located in a State party's own sovereign territory (para. 9.4.3).
The following is the text of the relevant part of the judgment of the Court:
…
9.1. Finally, the complaint argues (in short) that by the construction of the “new Semmering base tunnel” the status of the existing Semmering Railway and its surrounding cultural landscape as cultural or natural heritage under the Convention concerning the Protection of the World's Cultural and Natural Heritage, Federal Law Gazette No 60/1993 (UNESCO Convention), would be endangered. In recent years, the Republic of Austria had little by little undermined its obligations under international law pursuant to the UNESCO Convention, in favour of the “new Semmering base tunnel”. It would have to be examined whether the UNESCO World Heritage Committee or the UNESCO World Heritage Centre had been informed of this course of action. The Federal Monuments Office, by way of decision of 17 March 1991, had declared the existing Semmering Railway, exclusive of the train stations Gloggnitz and Mürzzuschlag, to be a protected monument. Something similar applies to the landscape conservation area “Stuhleck—Pretul”, which has been reduced to a third of its original size by way of regulation. According to the Operational Guidelines for the UNESCO Convention, domestic protection is a basic requirement for “cultural or natural heritage sites” pursuant to the UNESCO Convention.
The construction of the “new Semmering base tunnel” would lead to grave adverse effects on the natural water balance and ecosystem of the cultural landscape that surrounds the Semmering Railway. By acceding to the UNESCO Convention, the Republic of Austria had
undertaken not to take deliberate measures that might damage the cultural or natural heritage. The realization of “new Semmering base tunnel” would lead to a violation of that obligation under international law. As it would not be possible to remedy the effects on the world or cultural heritage [of] Semmering Railway and its surrounding cultural landscape through requirements, conditions, time limitations, project modifications or compensatory measures, the request of the involved party (mitbeteiligte Partei) would have had to be rejected.
