38. Bundesgesetz, mit dem das Niederlassungs- und Aufenthaltsgesetz geändert wird
Der Nationalrat hat beschlossen:
Das Niederlassungs- und Aufenthaltsgesetz (NAG), BGBl. I Nr. 100/2005, zuletzt geändert durch das Bundesgesetz BGBl. I Nr. 22/2009, wird wie folgt geändert:
1. § 69a samt Überschrift lautet wie folgt:
"Besonderer Schutz
§ 69a. (1) Im Bundesgebiet aufhältigen Drittstaatsangehörigen ist trotz Vorliegens eines Erteilungshindernisses gemäß § 11 Abs. 1 Z 3 bis 6 sowie trotz Ermangelung einer Voraussetzung gemäß § 11 Abs. 2 von Amts wegen oder auf begründeten Antrag, der bei der örtlich zuständigen Behörde im Inland einzubringen ist, eine Aufenthaltsbewilligung für besonderen Schutz zu erteilen:
1. | wenn der Drittstaatsangehörige einer Gefahr gemäß § 50 FPG ausgesetzt ist und ein Abschiebungsaufschub (§ 46 Abs. 3 FPG) bereits mehr als ein Mal und insgesamt mindestens für ein Jahr gewährt wurde; |
2. | zur Gewährleistung der Strafverfolgung von gerichtlich strafbaren Handlungen oder zur Geltendmachung und Durchsetzung von zivilrechtlichen Ansprüchen im Zusammenhang mit solchen strafbaren Handlungen, insbesondere an Zeugen oder Opfer von Menschenhandel oder grenzüberschreitendem Prostitutionshandel oder |
3. | wenn der Drittstaatsangehörige, der im Bundesgebiet nicht rechtmäßig aufhältig oder nicht niedergelassen ist, Opfer von Gewalt wurde, eine einstweilige Verfügung nach §§ 382b oder 382e EO erlassen wurde oder erlassen hätte werden können und der Drittstaatsangehörige glaubhaft macht, dass die Erteilung der Aufenthaltsbewilligung zum Schutz vor weiterer Gewalt erforderlich ist. |
(2) Hinsichtlich des Vorliegens der Voraussetzungen nach Abs. 1 hat die Behörde vor der Erteilung der Aufenthaltsbewilligung eine begründete Stellungnahme der der zuständigen Fremdenpolizeibehörde übergeordneten Sicherheitsdirektion einzuholen. Bis zum Einlangen dieser Stellungnahme bei der Behörde ist der Ablauf der Fristen gemäß Abs. 3 und § 73 AVG gehemmt. Anträge gemäß Abs. 1 begründen kein Aufenthalts- oder Bleiberecht nach...
